Insolvency and Bankruptcy Code (‘IBC’) has overhauled the existing framework and revolutionized the way corporate insolvency and liquidation is dealt in India.
It has shifted the paradigm from “Debtor in Possession” to “Creditor in Possession”, empowering creditors with control in the event of a default in repayment of any debt. Our team plays a vital role in providing support in corporate insolvency and bankruptcy procedures by assisting creditors/debtors in sustenance during debt recovery in different phases of process involved. We provide gamut of services ranging from advising distressed corporates/ creditors and representing them before various Tribunals, Courts and Authorities in the resolution processes.
The services broadly include:
Consultation Services to Corporate Debtor/Debtors, Creditors, IPs, Resolution Applicants, Guarantors and Other stakeholders under Insolvency Legal Framework (IBC);
Transactional Advisory to IRPs/IPs/Liquidators during Resolution Process/CIRP, Liquidation, Pre-pack IRP, Fast Track CIRP, Insolvency Proceedings against Personal Guarantors etc.;
Litigation & Representational Services before Adjudicating Authorities (NCLTs/DRTs), Appellate Tribunals (NCLAT/DRAT), IBBI, High Courts, and Hon’ble Supreme Court;
- Advisory, Assistance and Drafting of Resolution Plans and other necessary documentations as needed by Resolution Applicants for the bidding process under IBC;
